CODY (WNE) — The penalties for misdemeanor theft were effectively doubled by the legislature last week.
SF007 increased the maximum penalties for individuals convicted of stealing less than $1,000 worth of goods. The senate file raised the maximum imprisonment from six months to one year and raised the maximum financial penalty from $750 to $1,500.
Additionally, SF007 enforces a more strict policy for repeat offenders. Previously, individuals found guilty of misdemeanor theft for a fifth time were subject to a maximum prison term of 10 years and a $10,000 fine. However SF0007 lowered the requirement for that increased punishment to those guilty of a third misdemeanor charge.
The theft amendments passed the Senate with unanimous approval before being approved by a 55-4 margin in the House last week and subsequently signed by the governor. The updated penalties go into effect this year on July 1.
The state Department of Corrections said the fiscal impact of the increased penalties is indeterminable; however, it noted that the annual cost of incarceration is approximately $45,000 per inmate.
In a statement sent to the Enterprise, National Federation of Independent Businesses state director Michael Smith lauded the passing of the stricter penalties for theft.
“Nearly every small business has experienced shoplifting, which directly affects their ability to operate and grow. Deterring theft with stiffer penalties will help protect small business owners, their employees, and their customers,” Smith wrote.
